What is redundancy?

Redundancy occurs when an employer reduces its workforce due to if:

βœ”οΈ The business is closing.
βœ”οΈ The business continues, but the building in which you work in has closed.
βœ”οΈ The business requires fewer employees than the one it employs.
βœ”οΈ The introduction of new technologies makes your work unnecessary.
βœ”οΈ Your employer's business is slowing down, and your employer needs to cut costs by reducing the number of employees.

Any other reason that has been given by your employer that is not in the definitions above is an unlawful redundancy and may submit you to an automatic claim.

Although employers will often label layoffs as unnecessary, the two things are not the same. For this reason, if you lose your job and your employer finds someone to replace you, it is not redundant.

In such circumstances, you may have reason to file a wrongful termination claim.

Pregnancy discrimination involves treating a woman (an applicant or employee) unfavourably because of pregnancy, childbirth, or a medical condition related to pregnancy or childbirth.

Examples of unfavourable treatment and detrimental treatment include:

βœ”οΈ Selection for redundancy on the grounds of pregnancy.
βœ”οΈ Dismissal because of pregnancy.
βœ”οΈ Refusal of training or promotion opportunities.
βœ”οΈ Reduction of pay or hours.
βœ”οΈ The pressure to resign
βœ”οΈ Failure to carry out a risk assessment and take action to protect your health and safety.

Here's an example of a hypothetical situation to have a better understanding on pregnancy-related discrimination

What are employment tribunals?

An employment tribunal is an independent judicial body aimed at resolving disputes between employers and employees.

The types of claims you can make to a tribunal include, or are related to:

βœ”οΈ Discrimination (e.g., gender, race, religion or belief, sexual orientation, age, or disability)
βœ”οΈ Unfair dismissal
βœ”οΈ Wrongful dismissal
βœ”οΈ Constructive dismissal
βœ”οΈ Redundancy payment
βœ”οΈ Unequal pay
βœ”οΈ Deduction from wages.

Employment tribunals are less formal than the court process, yet the two processes are still similar in many ways.

For example, almost all hearings are open to the public. Furthermore, tribunals cannot provide legal advice, and they must involve you and others to testify under oath.

What is Constructive dismissal?

Constructive dismissal is where you are forced to resign in response to your employer’s conduct, which has made your position untenable. Although it’s referred to as a β€œdismissal” in law, it is, in practical terms, a resignation.

You must have been continuously employed with the same employer for two years to bring
a claim saves for any automatic right to bring the claim.

If you can show that your employer has fundamentally acted in a way that makes your
position untenable and goes to the root of your employment relationship, then your claim
may well succeed.

However, it is on you to prove that your employer has breached the contract.
This differs from unfair dismissal claims where it is for your employer to prove that there had been a fair dismissal.

Some examples of fundamental breaches of contract are:
● Discrimination
● Harassment
● Failure to pay wages
● Bullying
● Excessive demotion or disciplining
● Significantly changing an employee’s job description at short notice
